in the United States boasting 13 glass factories within the city
limits. These thriving businesses were provided resources through
two local excavation companies which harvested the rich lime quarries

AN ORDINANCE
To amend the traffic control map and file for the City of Fostoria, Ohio, and declaring an emergency.
WHEREAS, the Council of the City of Fostoria, Ohio has undertaken a review of the traffic control map and file of the City, and deems it necessary to amend said map and file; and,
WHEREAS, the Council of the City of Fostoria, Ohio deems said amendments necessary to preserve the flow of traffic in a safe and efficient manner; and,
WHEREAS, the Council of the City of Fostoria, Ohio desires to make said amendments to permit safety vehicles to pass narrow City streets unimpeded.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Fostoria, Seneca, Hancock, and Wood Counties, Ohio:
SECTION 1. No vehicles shall be parked as follows:
1) On the south side of Center Street from Vine Street to Lakeview Drive; 2) On the south side of North Street from Vine Street to Lakeview Drive; 3) On the west side of Grant Street from North Street to Center Street; 4) On the north side of Fourth Street from South Poplar Street to South Main Street; 5) On the south side of Foster Street from Vine Street to Lunt Street; 6) On the west side of North Poplar Street from East High Street to East Jackson Street; 7) On the west side of Maple Street from East High Street to East Jackson Street; 8) On the west side of Cory Street from West Jackson Street to West Culbertson Street; 9) On the west side of Leonard Street from West Jackson Street to West Culbertson Street; 10) On the south side of East Sixth Street from South Poplar Street to South Main Street. SECTION 2. No vehicles shall be parked on Rock Street between the hours of 7:30 a.m. and 8:30 a.m., and 2:30 p.m. and 3:30 p.m. SECTION 3. That the flow of traffic on an unnamed alley to the south of the West Tiffin street overpass, bounded by Adams Street and Independence Avenue, shall henceforth be one-way only, westbound. SECTION 4. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal actions were in meetings open to the public, and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 5. This ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare. The reason for this emergency is that the aforesaid amendments are critical to public safety, and orderly and efficient traffic flow.
THEREFORE, upon the affirmative vote of two-thirds (2/3) of all members elected to Council, and signature by the Mayor, this ordinance shall go into immediate force and effect. Passed this day of , 2010.

AN ORDINANCE
Vacating a portion of an unnamed alley in the First Ward of the City of Fostoria, Seneca County, Ohio and declaring an emergency to exist.
WHEREAS, a petition filed Maria Flores and Pilar Bustamante has been presented to the Council of the City of Fostoria, Ohio requesting the vacation of a portion of an unnamed alley as hereinafter described. A copy of said petition along with a map of said alley are attached hereto and marked as Exhibits “A”; and,
WHEREAS, Notice of the Pendency of this petition and Notice of Intention to vacate that portion of an unnamed alley has been waived and consent to the vacation has been given by all of the adjoining property owners of the land abutting that portion of the unnamed alley sought be vacated; and,
WHEREAS, the Council of the City of Fostoria, Ohio, upon application, is satisfied that there is good cause for the vacation as requested and that it will not be detrimental to the general interests and ought to be made.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Fostoria, Seneca, Hancock, and Wood Counties, Ohio:
SECTION 1. That the portion of an alley hereinafter described in Section 2, infra, is hereby vacated reserving, however, all rights thereto now enjoyed by public utilities now using the premises and further reserving easements for water and sewer lines; provided, however, that easements for water and sewer lines shall be exercised and valid only so far as the same may be done without interfering with buildings or other structures which have been placed on the premises prior to the installation of any water or sewer lines. Petitioners own property adjoining the unimproved alley; said alley is unimproved and in disrepair. SECTION 2. That the alley to be vacated is hereinafter describe as follows: Being a public alley situated in the 1st Ward of the City of Fostoria, Ohio, County of Seneca, Kenowers Addition (Vol. 1 pg. 52) and further described as follows:
Beginning at the northeast corner of Lot No. 1287 as owned by Maria Flores (Vol. 442, Pg. 124) also being the west right of way line of Spruce Street and further described as follows: Thence from said point of beginning along the north line of said Lot No. 1287, in a westerly direction, a distance of 132 feet more or less to the west line of said Lot No. 1287 also being the northwest corner of said Lot No. 1287 and the east right of way line of an unnamed north-south public alley; thence in a northerly direction along said unnamed north-south public alley a distance of 15 feet more or less to the southwest corner of Lot No. 1286 as owned by Pilar Bustamante (Vol 307, pg. 2238); thence along the south line of said Lot No. 1286, in an easterly direction, a distance of 132 feet more or less to the southeast corner of said Lot No. 1286 also being the west right of way line of Spruce Street; thence in a southerly direction along the west right of way line of Spruce Street, a distance of 15 feet more or less to the point of beginning.
Containing a public alley 15 feet in width and 132 feet in length for a total of 1,980 square feet more or less. SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal actions were in meetings open to the public, and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 4. This ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare. The reason for such emergency lies in the fact that the orderly administration of said vacation should be done as soon as possible in order to properly maintain the records of the City of Fostoria.
THEREFORE, upon the affirmative vote of two-thirds (2/3) of all members elected to Council, and signature by the Mayor, this ordinance shall go into immediate force and effect. Passed this day of , 2010.

Council President Joe Droll called the regular meeting to order at 7:30 p.m.
Invocation by Reverend Michael Malcosky of Wesley United Methodist Church. Allegiance was pledged to the Flag.
Roll call of councilpersons showed six (6) councilpersons present. It was moved by Councilperson Feasel and seconded by Councilperson Lake to excuse Councilperson Lee, passed by six (6) votes. It was moved by Councilperson Lake and seconded by Councilperson Widmer to approve the minutes of the regular meeting of July 20, 2010, and the special meeting of July 27, 2010, passed by six (6) votes. The minutes of the regular meeting of July 20, 2010 and the special meeting of July 27, 2010, were approved. COMMUNICATIONS

Councilperson Marley reported the following for the committee which met from 4:00 p.m. to 4:15 p.m. on Monday August 2, 2010:

Councilperson Marley noted the next finance meeting will be August 16, 2010 at 4:00 p.m. in the conference room.

REPORT OF OFFICERS
A. MAYOR: 1. The Mayor said Zoning Inspector Jason Wickard accepted another job and resigned as the zoning inspector. Mayor Davoli said we are currently taking applications to fill the position.
2. The Mayor said we are closer to making a selection for the fire chief and hope to make an announcement early next week.

1. Mr Fligor reported the city received a grant to construct a building to house snow removal equipment and rehabilitate the west apron at the airport. The grant was $150,000.00 and should cover the cost of these two projects.
2. Mr. Fligor requested an executive session do discuss personnel after the regular meeting.

F. PUBLIC: Jason Root 332 N. Main Street and a Fostoria Fire Fighter said he wants to form a committee to support the proposed tax issue. He also said he has some ideas to put money back into the general fund and asked for some feed back on these ideas.
Paul Allison 118 ½ W. Center St. presented Council a list of out dated codified ordinances and recommended they be reviewed and possibly removed. He also asked if the rules for City Council have been reviewed since the charter has taken effect.

Council President Droll said he had a request for an alley vacation and forwarded it to the Law and Ordinance Committee.
Mayor Davoli said the administration is looking to have trick or treat and the Halloween Parade on Sunday October 31. The parade would start at 4:00 p.m. and trick or treat would start at 6:00 p.m. for one hour.
EXECUTIVE SESSION:
It was moved by Councilperson Lake second by Councilperson Feasel to move into executive session to discuss personnel with no business to follow, passed by six (6) votes. Council moved into executive session at 7:58 p.m.
It was moved by Councilperson Feasel second by Councilperson Widmer to come out of executive session, passed by six (6) votes. Council came out of executive session at 8:53 p.m.
